Jurisdiction and Enforceability


Governing Law

Use of this site shall be governed by and construed in accordance with the laws of the State of Florida without giving effect to any principles of conflicts of laws.



Severability

If any provision of these Terms is held unlawful, void or unenforceable, the remaining provisions shall remain valid and in effect to the fullest extent possible.



Jurisdiction and Venue

For any claim or dispute that arises under these Terms, exclusive jurisdiction and venue shall be with a court of competent jurisdiction in Leon County, Florida. You consent to the jurisdiction of such courts and agree to accept service of process issued by such courts.



Intellectual Property


Endorsements

You may not use Citizens’ name or trademarks in any way that implies affiliation with, or an endorsement, sponsorship or approval by Citizens without express written permission.



Licensed Materials

Various text, forms and images appearing on this site are used under license by Citizens for this site. These materials are for viewing purposes only. Any reproduction may be prohibited under federal/state copyright or trade secret laws.



Miscellaneous


Personal Use Only

You will use the site only for your personal, noncommercial use unless you and Citizens have agreed otherwise in writing. Use in connection with policies or accounts with Citizens in the name of your business is considered personal use.



Waivers

Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Citizens. Any delay or omission by Citizens to exercise any rights under these Terms shall not be construed to waive any rights.



Section Headings

The section titles and headings are not part of the Terms and are not to be used in interpreting the Terms.



Conflicts

In the event of a conflict between these Terms and your policy with Citizens, the policy shall control.



Notices

If you have registered at this site we will notify you of any material changes to these Terms by using any of the contact information you have provided to us. These changes will not apply to disputes that arise prior to the effective date of the change.



Survival

Certain provisions of these Terms by their nature shall continue in full force and effect after termination, including authorizations you have granted, the Disclaimer of Warranties and Jurisdiction/Enforceability.



Paperless Delivery Terms and Conditions

These terms and conditions describe Citizens’ paperless delivery for Personal Lines policy and billing documents. To use this service, you must be the first-named insured, your myPolicy email address must match the email address on file for the policy and the username must remain the same as your myPolicy log in credentials.

  • By accepting, you consent to receive your new policy and billing documents for your policy mailing address electronically. Some documents will continue to be mailed regardless of enrollment status.

By enrolling, you will receive an email notification when your documents are available online. The email will contain a link to your myPolicy account from which to access the new policy and billing documents.

You are responsible for maintaining an active email account with your internet provider. If there are any changes to your email address, you will provide Citizens and/or your agent with an updated email address. If Citizens is not informed of any changes to the first-named insured’s email address on file for the policy or does not otherwise become aware that the email address has changed, Citizens will be held harmless for any electronic notification made to the email address on file with Citizens in lieu of mailing the documents by U.S. mail to the policy’s mailing address. The failed delivery of any email notification will result in the cancellation of your paperless enrollment. You will be notified via mail if this occurs, and all future documents will be sent via U.S. Postal Service.

Your consent to enroll and participate in the service will remain in effect until you unenroll or the service is terminated for any reason. If the service terminates for any reason, you will receive documents by mail via U.S. Postal Service to the mailing address listed on the policy.

At any time, Citizens reserves the right to amend this agreement and you may terminate your enrollment in paperless delivery.



SMS Text Messaging Terms and Conditions


Introduction

Citizens Property Insurance Corporation (Citizens) may send text messages to policyholders in the event of weather-related emergencies. For text messaging purposes, emergencies can be any weather event, named or unnamed, with the potential to cause property damage. Text messages may be sent prior to or after a storm, and the message content will vary depending upon if the insured’s property is identified as being in an area potentially impacted by the weather-related emergency or is in the area that was impacted by the emergency.

Read these terms and conditions carefully regarding our Short Message Service (SMS service). You may receive non-marketing text messages from Citizens, including text messages made with an autodialer, at the telephone numbers that you provided. You may opt-out of these communications at any time using the instructions below. Consent to receive text messages is not required to purchase insurance from Citizens.



Program Description

Citizens may use an automatic telephone dialing system (autodialer) to deliver text messages to you. Text messages may include but not be limited to information regarding an impending weather-related event, services available to you from Citizens subsequent to the occurrence of a weather-related event, and/or information regarding assistance available to you in the event that you need to file a property insurance claim.



Message Frequency

The specific number of text messages may vary depending on the weather-related event and if your property is identified as being in the area potentially-impacted by the weather-related event or your property is in the area that was impacted by the event.



Cost

Message and data rates may apply to each text message sent or received, as provided in your mobile telephone service rate plan (please contact your mobile telephone carrier for pricing plans), in addition to any applicable roaming charges. Company does not impose a separate fee for sending text messages.



How to Opt-Out

To stop receiving text messages, text STOP to 46732. You may also call, email, or write Citizens to inform that you do not want to continue receiving text messages. When you opt-out, you agree to receive a text confirming that your opt-out choice has been recorded.



Your Mobile Telephone Number

You represent that you are the account holder for the mobile telephone numbers that you provided to Citizens. You are responsible for notifying us immediately if you change your mobile telephone number.



Privacy

Data obtained from you in connection with the text messages may include your name, address, mobile phone number, your mobile service provider’s name, and the date, time, and content of your messages. Our use of this information will be in accordance with our Privacy Policy. Your mobile carrier and other service providers may also collect data about your mobile device usage, and their practices are governed by their own policies.



Access or Delivery to Mobile Network is Not Guaranteed

Delivery of information and content to a mobile device may fail due to a variety of circumstances or conditions. You understand and acknowledge that network services, including but not limited to mobile network services, are outside of Citizens’ control, and Citizens is not responsible or liable for issues arising from them.



Changes to Terms and Conditions

We reserve the right to modify these SMS Text Messaging Terms and Conditions, or any part thereof, or add or remove terms at any time, and such modifications, additions or deletions will be effective immediately upon posting. Your continued enrollment in the SMS texting service shall be deemed to constitute acceptance by you of such modifications, additions or deletions.



Termination of Text Messaging

Citizens may suspend or terminate your receipt of text messages if Citizens believes you are in breach of these SMS Terms and Conditions. Your receipt of text messages is also subject to termination in the event that your mobile telephone service terminates or lapses. Citizens reserves the right to modify or discontinue, temporarily or permanently, all or any part of text messages, with or without notice.
