Coastal Construction Control Line and Coastal Barrier Resources System Zones

Due to recent changes in Florida law, there are new eligibility rules for certain structures located seaward of the state-designated Coastal Construction Control Line (CCCL) and those within the federally designated Coastal Barrier Resources System (CBRS). These geographical zones were developed to provide protection for Florida’s coastline while ensuring reasonable use of private property.

New Eligibility Rules

Effective immediately, any major structure (for example, homes, apartments, condos, commercial or public buildings*) for which a permit is applied after July 1, 2015, and that is seaward of the CCCL or within the CBRS, may be deemed ineligible for coverage if it is one of the following:

  • Newly constructed
  • Rebuilt, repaired, restored or remodeled to increase the total square footage of the finished area by more than 25 percent

This rule is applicable to all new and renewal business for all policy types except personal lines tenant contents and commercial lines business personal property policies.
 
PolicyCenter® updates are under development and will be in place later this year. A separate communication detailing those changes will be sent prior to the implementation of the updates.
 
While this new legislation is effective immediately, it references permits applied for after July 1, 2015.  We do not expect any impact to personal lines risks prior to PolicyCenter updates. There may be an impact to commercial Builders Risks prior to our updates, but we expect the number of instances to be low.

At this time, there are no changes to the application submission process.

  • Citizens underwriting manuals will be updated with CCCL/CBRS information. 
  • CCCL/CBRS boundaries are subject to change by the administering authorities.

  • Coastal Construction Control Line 
  • Coastal Barrier Resources System

Regarding PolicyCenter:

  • The Coastal Construction Information section appears on the Location Information screen for commercial lines and the Property Address Info screen for personal lines.
